THIS IS TO CERTIFY that at the regular session duly constituted of the Sangguniang Panlalawigan, Province of Pangasinan, held on May 23, 2011 at Lingayen, Pangasinan, the following provincial resolution was approved:

PROVINCIAL RESOLUTION NO. 223-2011



DECLARING THE ANNUAL BUDGET FOR CALENDAR YEAR 2011 OF SAN FABIAN, PANGASINAN WITH A TOTAL APPROPRIATION OF PHP97,401,062.00 OPERATIVE IN ITS ENTIRETY


WHEREAS, pursuant to R.A. No. 7160, otherwise known as the Local Government Code of 1991, the Sangguniang Panlalawigan of Pangasinan as a legislative body of the Province is empowered to review ordinances authorizing annual or supplemental appropriations of component cities and municipalities in the manner prescribed by law;

WHEREAS, the Sangguniang Bayan of San Fabian, Pangasinan submitted its Annual Budget for Calendar Year 2011 involving total appropriations of P97,401,062.00 which was approved on December 21, 2010 through Appropriation Ordinance No. 5, S-2010;

WHEREAS, the Committee on Laws and Ordinances of the Sangguniang Panlalawigan with the technical assistance of the Local Finance Committee pursuant to Section 316 of the Local Government Code of 1991, have conducted preliminary review and study on said budget with the following findings:

1.    All procurements to be undertaken shall be subject to the pertinent provisions of RA 9184 (The Government Procurement Reform Act) and its revised implementing rules and regulations;

2.    All programs, projects and activities shall be in accordance with the approved Local Development Plan and the FY 2011 Annual Investment Program of the municipality formulated pursuant to DILG-NEDA-DBM-DOF Joint Memorandum Circular No. 1, S-2007 dated 08 March 2007;

Further, the utilization of the appropriations is subject to the authorization of the Sanggunian on the list of projects to be implemented as ruled by the Supreme Court in the case of Hon. Gabriel Luis Quisumbing, et. al., vs. Hon. Gwendolyn F. Garcia, et. al., G.R. No. 175527, 08 December 2008;

3.    The full implementation of the Second Tranche Monthly Schedule of local government personnel shall be in accordance with Local Budget Circular No. 95 dated June 29, 2010; and

4.    The ordinance creating the new positions in the Office of the Municipal Budget Officer should be submitted.

WHEREAS, the Sangguniang Panlalawigan, after final evaluation, finds the same in order provided that the above-findings shall be complied with by the municipality;

NOW, THEREFORE, in view of the foregoing, on motion of SP Members Jeremy Agerico B. Rosario and Mojamito R. Libunao, Jr. and co-sponsored by SP Members Amadeo T. Espino, Salvador S. Perez, Jr. and John Christopher A. Arcinue, duly seconded, it was –

RESOLVED, as it is hereby resolved, by the Sangguniang Panlalawigan in session assembled, to declare OPERATIVE IN ITS ENTIRETY the Annual Budget for Calendar Year 2011 of San Fabian, Pangasinan as of January 1, 2011; provided, that the disbursement of appropriations as approved shall be subject to the existing accounting and auditing rules and regulations, and compliance with other pertinent laws, rules and regulations shall be the responsibility of the Municipal Government of San Fabian and shall serve as basis for auditing purposes of the Commission on Audit;

RESOLVED, FINALLY, that copies of this resolution be furnished the Municipal Budget Officer of San Fabian, Pangasinan and the Provincial Auditor’s Office, for their information and guidance.
